1. General

1.1. Contract partner/purchase contract
For orders via the Cleanair Online Shop, the contractual partner of the customer is SYTECH Andreas Winter GmbH, hereinafter referred to as SYTECH.
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue. By clicking on the button “Send order” you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order will be made immediately after the order has been sent by automated e-mail together with the acceptance of the order.
With this e-mail confirmation the purchase contract has been concluded.

2. Offer and subject matter of contract

2.1. The offers are subject to change in terms of performance and quantity.

3. Packaging and shipping

3.1. Our price corresponds to the price quoted on our website at the time of ordering. We reserve the right to change the price due to a typing error, transmission error or calculation error.
The cost of shipping shall be borne by the customer.

3.2. The shipping costs depend on the shipping method, the number of products and the shipping destination.
If not ordered via our Cleanairtech Online Shop with credit card, we ship the products via Österreichsche Post AG (http://www.post.at/tarifrechner. php) at the buyer’s expense by cash on delivery.


4. Delivery

4.1. Delivery shall be made to the delivery address within Austria specified by the Buyer.

4.2. We are entitled to make partial deliveries and in the case of partial deliveries we bear the additional shipping costs resulting from this.

4.3. If the agreed delivery deadline cannot be met, the seller shall grant a reasonable period of follow-up delivery. If the Seller fails to deliver within the stipulated period of subsequent delivery, the Buyer may withdraw from the contract.

4.4. Any disruption in the business operations of the Seller or its suppliers for which the Seller is not responsible, in particular labour riots and lawful lockouts as well as cases of force majeure shall extend the delivery time accordingly.

5. Transfer of risk

5.1. The risk of having to pay the purchase price in spite of losses or damage shall pass to the purchaser with the handover.

6. Warranty

6.1. The warranty period complies with the statutory provisions.

6.2. If the Buyer is an entrepreneur, the limitation period for warranty claims is reduced to 1 year.

6.3. To remedy a defect, the purchaser is first entitled to the right to supplementary performance, whereby he has the right to choose between rectification of the defect (re-improvement) or replacement delivery of a defect-free product.

6.4. The Seller may refuse the rectification or replacement if it is only possible at disproportionate costs and the other type of rectification has not been provided within a reasonable period of time or has been definitively refused by the Seller.

6.5. Should the subsequent performance fail, the purchaser may withdraw from the contract or demand a reduction of the purchase price. This also applies if the subsequent performance has not been provided within a reasonable period of time or has been definitively refused by the seller.

6.6. If the Buyer chooses to withdraw, he shall return the defective goods and pay compensation for the use made.

6.7. The warranty does not extend to damages for which the Buyer is responsible, such as damages caused by natural wear and tear, humidity, severe heating of the rooms, intensive exposure to sunlight or artificial light, other temperatures, weather or improper treatment.

6.8. Please note that the colors may differ from the original product due to compression of the images or screen display.

7. Payment arrangements

7.1. The purchaser can refer to the payment terms of the website for the different payment methods.

7.2. The Seller may also, for justified reasons, demand that the delivery be made only by cash on delivery or against prepayment. If the purchaser does not want to accept this, he is entitled to withdraw from the contract.

8. Reservation of title

8.1. All delivered goods remain the property of the Seller until the purchase price has been paid in full.

9. Widerrufsrecht

9.1. Consumers have a two-week right of withdrawal when ordering goods online.

You may revoke your declaration of contract within two weeks without giving reasons in text form (e. g. letter, fax, e-mail) or – if the goods are handed over to you before the deadline has expired – by returning the goods. The period begins after receipt of this instruction in text form, but not before receipt of the goods by the consignee.

Withdrawal consequences (for consumers only) for online orders of goods.
In the event of an effective revocation, the services received by both parties shall be returned and any benefits (e. g. interest) shall be returned. If you are unable to return the received service to us in whole or in part or only in a deteriorated condition, you must compensate us in this respect if necessary. This does not apply to the transfer of goods if the deterioration of the goods is due solely to their examination – as it would have been possible for you, for example, in a shop. In addition, you may avoid the obligation to compensate for any deterioration caused by the intended use of the item by not using the item as your property and by refraining from doing anything that detracts from its value.
Items suitable for parcel shipping are to be returned at our risk. You have to bear the costs of the return if the delivered goods correspond to the ordered goods and if the price of the goods to be returned does not exceed an amount of EUR 40 or if you have not yet paid the consideration or a contractually agreed partial payment at the time of revocation. Otherwise, the return is free of charge for you. Items that cannot be shipped by parcel will be picked up from you.
Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of your declaration of revocation or the item, for us with its receipt.

9.2. Please avoid damage and contamination. If possible, please return the goods to us in original packaging with all accessories and packaging components. If necessary, use a protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against damage during transport with suitable packaging to avoid claims for damages due to damage caused by defective packaging.

9.3. We are also happy to reimburse you in advance for the postage costs if you do not have to bear them yourself.

In this way, you enable us to assign the products as quickly as possible.

9.5. Please note that the modalities mentioned in paragraphs 9.2. to 9.4. are not a prerequisite for the effective exercise of the right of withdrawal.

This is how you can help us to quickly assign your return. We will send you the free return receipt of your parcel immediately.

11. Jurisdiction and place of performance

1. The legal provisions of the Code of Civil Procedure and the Civil Code apply to the place of jurisdiction and the place of performance.

2. If the Buyer does not have a general place of jurisdiction in Germany, has moved his domicile or habitual residence out of Germany after the conclusion of the contract, or his domicile or habitual residence is unknown at the time the action is brought, the place of performance and jurisdiction shall be the Seller’s principal place of business.

3. Is the Customer a Businessman in the Legal Sense the place of jurisdiction is the place of residence or the place of establishment of the seller.

12. Severability clause

If one provision is ineffective, the validity of the remaining provisions shall not be affected.

The product must be in new condition and returned with undamaged original packaging. For damaged or used items we can only refund part of the purchase price or not at all.

Please note that the modalities mentioned in the above paragraphs are not a prerequisite for the effective exercise of the right of withdrawal.
